Lenovo and MOTOROLA face a total ban in the German market!

Recently, the German market came a major news, well-known technology enterprises Lenovo and its MOTOROLA brand of mobile phones, tablets and laptops and other devices in Germany face a total ban on the dilemma!


According to German authoritative media WirtschaftsWoche reported on May 11, the ban stems from the Munich District Court's ruling on the 4G and 5G patent litigation between Lenovo and MOTOROLA and the US technology giant InterDigital. In that case, Lenovo and MOTOROLA lost, and InterDigital successfully obtained a preliminary injunction.


Although the injunction has not yet taken full legal effect, InterDigital chose to temporarily enforce the injunction by paying a deposit of up to 4 million euros (about 31.16 million yuan). However, Lenovo and MOTOROLA still have the opportunity to overturn the injunction through the appeal process.


The lawsuit focuses on the principle of FRAND (fair and reasonable and non-discriminatory terms) in patent licensing. InterDigital claims that it follows the FRAND principle in setting its patent licensing fees, but Lenovo and MOTOROLA dispute this. It is worth noting that the specific provisions of the FRAND principle in the EU are not yet perfect, which leaves some room for patent litigation.


In fact, this is not the first time that InterDigital and Lenovo-Motorola have gone to court over patent licensing fees. In June 2023, the UK High Court ruled that InterDigital's patent licensing fee should not be higher than $0.175 per device (about 1.26525 yuan).


In addition, in October last year, global telecommunications giant Ericsson also filed a lawsuit against Lenovo and its mobile equipment subsidiary MOTOROLA in the U.S. District Court of North Carolina. Ericsson accused Lenovo of infringing its 5G patent portfolio in 11 areas and claimed Lenovo had refused to negotiate a suitable licensing agreement for years to continue using its technology. Therefore, Ericsson believes that Lenovo and MOTOROLA Mobility are in violation of patent law.


The spate of patent lawsuits and bans is a huge blow to Lenovo and MOTOROLA. In the context of the total ban in the German market, the two companies will have to review their patent strategy and market layout. At the same time, it also reminds other technology companies to pay more attention to patent protection and intellectual property compliance.
